1. These terms
This website is operated by Rams Real Estate Development (“Rams”, “we”, “us”, “our”) of Erbil, Kurdistan Region of Iraq. By accessing or using this website you agree to these terms of use. If you do not agree to them, please do not use this website.
We may revise these terms at any time by amending this page. The date above shows when they were last revised, and your continued use of the site after a revision means that you accept it.
2. The material on this site is indicative
Pavilion is a development under construction. Everything published on this website is provided for general information and marketing purposes only. In particular:
- images, renders, films, animations, plans, elevations and the interactive views of the site and the lagoon are artistic impressions. They are not photographs of completed buildings and they are not to scale;
- areas, dimensions, room counts, plot numbers, distances, phasing and handover dates are approximate and subject to change as design and construction progress;
- specifications, finishes, materials, furniture, landscaping and amenities are indicative, and we may substitute items of equivalent or better quality;
- views shown from any villa or terrace are illustrative and depend on the plot, the level and the final layout of the development; and
- where a facility is described, its provision, operator and opening date may change.
Nothing on this website is an offer, an invitation to treat, a representation or a contract, and nothing on it forms part of any contract. No statement here should be relied upon as a statement of fact or as a promise. The only terms that bind us are those set out in a signed reservation, sale or purchase agreement between you and us, and you should rely on that document alone.
3. Ownership of the material on this site
All content on this website belongs to us. Every photograph, every video, every film, every render, every animation, every drawing, plan and floor plan, every illustration, icon and map, together with all text, the design and layout of the site, its source code, and the Pavilion and Rams names, logos and other marks, are owned by Pavilion by Rams or used by us under licence, and are protected by copyright, trade mark and other intellectual property laws in the Kurdistan Region of Iraq, in Iraq and internationally. All rights are reserved.
You may view this website, and print or download extracts, for your own personal and non commercial use in considering a purchase. You must not:
- copy, reproduce, republish, upload, post, transmit, distribute, sell or licence any photograph, video or other material from this site;
- use any of our material for advertising, listings, brochures, social media accounts or any other commercial purpose;
- alter, crop, edit or create derivative works from any of it, or use it in a way that suggests any association with or endorsement by us;
- remove or obscure any copyright notice, watermark, credit or other proprietary marking; or
- extract, scrape, harvest or index the content of this site by any automated means, or use it to train or develop any software or machine learning model.
Any use not expressly permitted above requires our prior written consent. We enforce our rights in this material, and unauthorised use may result in civil proceedings for damages and injunctive relief, and in a criminal complaint where the law provides for one.
4. Acceptable use
You may use this website only for lawful purposes. You agree not to use it in any way that breaches any applicable law, that is fraudulent or deceptive, or that harms or attempts to harm any person.
5. Security, interference and unauthorised access
You must not attempt to gain unauthorised access to this website, to the server on which it is stored, or to any server, computer, database, account or network connected to it. Without limitation, you must not:
- probe, scan or test the vulnerability of this site or any related system, or breach or attempt to breach its security or authentication measures;
- access, alter, delete, damage, copy or exfiltrate any data, account or file that you are not authorised to access;
- introduce or attempt to introduce any virus, trojan, worm, logic bomb, ransomware or other material that is malicious or technologically harmful;
- attack this site by means of a denial of service attack or a distributed denial of service attack, or otherwise interfere with its proper working or with any other person’s use of it;
- use any robot, spider, scraper or other automated means to access the site in a manner that imposes an unreasonable load on it, or to circumvent any measure we use to prevent or restrict access; or
- impersonate us, or misrepresent your identity or affiliation, in connection with this site.
Unauthorised access to a computer system is a criminal offence. Any attempt to hack, breach, disrupt, deface or otherwise interfere with this website or its systems, whether or not it succeeds, will be treated with the utmost seriousness. We record and retain technical evidence of such attempts, including internet protocol addresses and access logs, and we will report them to the competent authorities of the Kurdistan Regional Government and of the Federal Republic of Iraq, and to law enforcement and regulatory bodies in any other jurisdiction from which or through which the conduct is carried out.
We will cooperate fully with any resulting investigation or prosecution, and we will pursue every remedy available to us. That includes criminal complaint and prosecution under the applicable laws of the Kurdistan Region of Iraq and of Iraq, civil proceedings for damages, an account of profits, and injunctive relief, together with the costs of investigation, remediation and enforcement, and referral to the relevant hosting, network and payment providers. We may also suspend or block access to this site from any address or account involved.
6. Availability
We do not guarantee that this website, or any content on it, will always be available or uninterrupted. We may suspend, withdraw or restrict all or any part of it for business or operational reasons, and we will try to give reasonable notice of any planned suspension. We are not liable to you if this site is unavailable at any time or for any period.
You are responsible for making the arrangements necessary for you to access this site, and for ensuring that everyone who accesses it through your connection is aware of these terms and complies with them.
7. Liability
To the fullest extent permitted by law, we exclude all conditions, warranties, representations and other terms that might otherwise be implied into these terms, and we are not liable for any loss or damage, whether in contract, tort including negligence, breach of statutory duty or otherwise, arising from or in connection with the use of, or the inability to use, this website, or reliance on any content on it. This includes any loss of profit, revenue, business, goodwill, opportunity, anticipated saving or data.
Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under applicable law.
8. Links to other sites
Where this website links to a site or resource operated by somebody else, including our accounts on third party social media platforms, those links are provided for your information only. We have no control over the contents of those sites and we accept no responsibility for them or for any loss or damage that may arise from your use of them. Their own terms and privacy notices will apply to you when you visit them.
9. Privacy
Our privacy notice explains what personal information we collect through this website, why we collect it, and the rights you have. It forms part of these terms.
10. Governing law and jurisdiction
These terms, their subject matter and their formation, and any dispute or claim arising out of or in connection with them or with your use of this website, whether contractual or non contractual, are governed by the laws in force in the Kurdistan Region of Iraq and, where applicable, the federal laws of Iraq. You and we agree that the competent courts of the Kurdistan Region of Iraq, sitting in Erbil, have exclusive jurisdiction, save that we retain the right to bring proceedings against you for a breach of section 3 or section 5 in any court of competent jurisdiction.
If any provision of these terms is found to be invalid or unenforceable, the remaining provisions continue in full force.
